Non-Dentists Prevented From Offering Teeth Whitening Services

The Dental Board in North Carolina has tried to stop non-dentists from offering teeth whitening services. Teeth whitening is less expensive when performed by people other than dentists, such services are available at salons, mall kiosks or retail stores. Dentists offer teeth whitening services in their offices but there are also take-home kits that they offer. Non-dentists offering teeth whitening services were discouraged by the actions of North Carolina Dental Board, but the Federal Trade Commission took action, complaining that competition is harmed by blocking non-dentists from offering teeth whitening services. As a result, such services became more expensive, so consumers were affected.

While the Dental Board considers service offered by non-dentists unauthorized practice, the Federal Trade Commission stated that excluding competitors is harmful for consumers. The complaint of the Federal Trade Commission is designed to be a form of active supervision by a disinterested state authority that can prevent exclusion of competitors by the Dental Board whose members have a financial interest in the industry.
